4. API Usage and Licensing

When you purchase API access:

  • You are granted a non-exclusive, non-transferable license to access and use our API in accordance with these Terms
  • Usage is subject to rate limits and other technical restrictions as communicated to you upon purchase
  • Reselling, redistributing, or sublicensing API access is prohibited without our express written permission
  • We reserve the right to monitor API usage and suspend access for abusive or excessive use

5. Payment Terms

Payment for API access and other premium services is due at the time of purchase. All fees are non-refundable unless otherwise specified in our Refund Policy.

We reserve the right to modify our pricing at any time, with notice provided to existing customers before renewal periods.

6. Prohibited Uses

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Extract or scrape data beyond the scope of normal use or API limits
  • Attempt to gain unauthorized access to any part of the Services

8. User Content

If you submit any information or content to the Services ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such User Content in connection with providing the Services.

You represent and warrant that you own or control all rights to the User Content you submit and that the User Content does not infringe or violate the rights of any third party.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected. We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of the information provided through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the revised Terms on our website or by other means.

Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Navis Apps LLC is registered, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in the jurisdiction where Navis Apps LLC is registered, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements and understandings, whether written or oral.
